Employer Nominated Visa (EN186)

If you have a skilled occupation that is on the Medium and Long-term Strategic Skills List (MLTSSL) and have an Australian employer who is willing to sponsor and offer you a position – then this may be the permanent resident visa for you.

This visa involves a two-stage process:

The employer must be an active and lawfully operating business in Australia. Upon lodgement of the nomination application, employers must also pay the Skilling Australians Fund (SAF) levy.

The skilled position offered is genuine and available for at least (but not limited to) two years. The employer needs to show that you will be paid at least the salary that is offered an employee who is an Australian citizen or permanent resident doing the equivalent role and at the same location.

Must be lodged at the same time as, or within 6 months of the approval, of the Employer Nomination. As an applicant you show you have the relevant skills and/or experience for the position. You will need also need to satisfy English language ability, health and character requirements.

There are three streams that are available in this visa Subclass:

Basic eligibility requirements include:

  • You must be under 45 years of age (some exemptions may apply)
  • Demonstrate you have at least three years’ work experience
  • Have a positive skills assessment
  • Have the appropriate license or registration (where applicable)
  • Meet English language requirements
  • Meet health and character requirements

Your employer can sponsor you to work in Australia permanently under the TRT stream if you are the holder of a 457 or TSS. 

Legislative changes effective from 25 November 2023 have relaxed requirements of this stream. These changes now enable you to apply for this visa if you have worked for your employer for at least two years (down from previous requirement of three years). You are also no longer restricted from applying as long as your nominated occupation was on a skills occupation list, whether it be STSOL, MLTSSL or ROL. 

The eligibility criteria for this visa include:

  • You must be under 45 years of age (some exemptions may apply)
  • Meet English language requirements
  • Meet health and character requirements

If you are currently working or will be working for an employer who has a labour agreement with the commonwealth, you can be sponsored under this stream.

Eligibility requirements include:

  • You must be under 45 years of age (some exemptions may apply)
  • If in Australia, you must hold 457 or TSS under the Labour Agreement stream
  • Have the appropriate license or registration (where applicable)
  • Meet English language requirements
  • Meet health and character requirements
